Diving Terms & Conditions

• OrcaNation dives with a maximum ratio of 2 to 4 divers per OrcaNation Dive Professional, depending on the activity and level of certification.
• All divers must complete a PADI medical form before diving activity commences.
• Dive Insurance is recommended for all customers diving with OrcaNation and can be purchased through OrcaNation ahead of diving if it is not included with the dive activity. 
• Open Water students must be able to swim 200m unaided, and comfortable in the water. For safety reasons, this will be tested prior to your dive experience. 
• Our instructors teach in English. At some of our dive centres, with advanced notice instructors may be able to teach in other languages, please contact us for more information.
• For bookings including accommodation, these are subject to the T&Cs of our partner hotels.
• Dive courses and programmes are priced per location, any changes to the delivery of diving activity or courses are subject to additional charges.

• Change of date(s) for pool practical or dive trip is permitted only with a minimum of 2 weeks’ advanced notice, subject to availability and additional charges may apply (as stated below).
• Postponement of any pool session less than 1 week from the scheduled date will be charged at SGD $100.00 (or equivalent local currency) per change, per participant.
• Any additional pool sessions deemed necessary by the instructor will be charged at SGD $125.00 (or equivalent local currency) per participant, per session.
• Where pool sessions are impacted by weather, alternative sessions will be scheduled where possible.
• Schedules mentioned on our website are subject to change without prior notice and subject to availability. 
• OrcaNation staff reserve the right to postpone, change the location of or cut short any activity at any time for safety (such as bad weather), or group management reasons and full price will be charged/no part or full refund or other type of compensation will be given. However, OrcaNation staff will do their best to change the activity to a more suitable location, date or time whenever possible.

• OrcaNation Instructors have complete discretion to refuse any diving participation of guests possibly under the influence of alcohol or drugs. No refunds will be given in these circumstances. 
• OrcaNation instructors have the right to reduce the length of a diving activity if guests are not respecting environmental rules or adhering to safe diving practices. No refunds will be given in these circumstances. 
• OrcaNation instructors have the right to refuse any diving participation of guests who they deem to be mentally or physically unfit to the extent that puts the client or any other person in danger during any activity. No refunds will be given in these circumstances. 
• Clients must follow local marine park rules,  failure to do so may incur a fine and or possible imprisonment. 
• Clients are responsible for the care of the equipment rented during activities and will financially compensate OrcaNation for any damage or loss due to negligence or misuse.
• If clients participate in a guided snorkelling tour, the equipment they use is only rented until 18:00 that same day & must be handed to an OrcaNation member of staff before this time. Failure to do so will result in a late fee being charged.
• Clients understand that they should not fly or reach an altitude above 300 metres for at least 24 hours following multiple dives or 18 hours following a single dive. If clients do not adhere to this rule, they will not hold OrcaNation responsible for any adverse effects.

• Cancellations of any courses / dive activities outside of one (1) month of course commencement will be refunded at 75% of the total dive activity cost. If PADI online material has been redeemed, this is reduced to 50%.
• Cancellation of any course(s) / dive activities within one (1) month of course commencement will be refunded 50% of the total dive activity cost. If PADI online material has been redeemed, this is reduced to 25%.
• There will be no refund for courses / dive activities cancelled within 1 week of activity commencement.
• Any refunds outside of our terms will be subject to a claim on the guests Insurance Company. We are happy to provide a letter, which can be given to the insurer as proof of loss, though OrcaNation cannot be held accountable if the claim is rejected for whatever reason. OrcaNation is not responsible for any charges caused by the transfer process in the event of a refund and if there is any alteration of the exchange rate. A no-show for whatever reason, including but not limited to, flight delays, illness, or missing a scheduled dive time will mean a loss of payment and no refund. 
• For closed port situations or bad weather, exchange products and/or other alternatives will be offered. Rainy or cloudy weather is no valid reason for cancellation, and we strictly follow harbour master and recommendations on when to cancel a tour. 
• Cancellation fee may be waived if guests choose to book an alternative activity (dependent on availability / value).
• For cancellation or rescheduling due to bad weather or other reasons, OrcaNation staff will make the final decision on whether an activity can take place. Clients should assume that the activity is going ahead and should turn up at the agreed location & time, unless told otherwise directly by OrcaNation staff. Failure to do so will be deemed a “no show”.
• Clients understand that water activities can be physically demanding and that they can become cold more easily when in water or could experience sea sickness. With this in mind, clients understand that no refunds will be given if the activity is cut short due to any participant feeling tired, cold or seasick.
• OrcaNation is not liable for failure to perform their obligations if such failure is as a result of Acts of God (including fire, flood, earthquake, storm, hurricane, volcanic ash cloud, or other natural disaster), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labour dispute or strike.

• Payment must be made prior to the commencement of any dive course or dive activity.  Please make sure you have fully completed the required medical declaration and paperwork before making payment, making sure any medical clearance has been received from a relevant medical professional if required.
• Prices quoted are where payment is made directly to OrcaNation bank accounts. Any charges incurred for bank transfer are payable by the payer.
• Where payments are made via a third party (such as an agent independent to OrcaNation), their payment terms will apply.
• Listed prices at OrcaNation Dive Centres may differ to those provided in advance. For walk-in sales, prices displayed at OrcaNation Dive Centres apply.
• In case of refunds, OrcaNation will refund via original payment method and not be liable for any charges of FX losses. 

Collection of Personal Data:

• At OrcaNation we will only collect personal data that is necessary for the purpose
  of providing our services to customers, for the management of our fixed and
  contingent labour and as explicitly agreed by contributors.
• Personal data will be collected directly from individuals and with their consent.
• We will inform individuals of the purposes for which their personal data is being
  collected and how it will be used.

Use of Personal Data:

• Personal data will only be used for the purposes for which it was collected,
  unless consent is explicitly obtained for other uses.
• At OrcaNation we will take reasonable steps to ensure that personal data is
  accurate, complete and up-to-date.
• Personal data will be securely stored and protected from unauthorised access or
  disclosure.

Disclosure of Personal Data:

• Personal data will not be disclosed to third parties without the consent of the
  individual, unless required by law.
• At OrcaNation we will only disclose personal data to third parties who have a
  legitimate need to access the information.

Access and Correction of Personal Data:

• Individuals have the right to request access to their personal data held by
  OrcaNation
• Individuals have the right to request corrections if the information is inaccurate or
  incomplete.
• At OrcaNation we will respond to such requests in a timely manner and make
  any necessary corrections as required by law.

Retention of Personal Data:

• At OrcaNation we will retain Personal data only for as long as necessary to fulfil
  the purposes for which it was collected, or as required by law.
• Once personal data is no longer needed, it will be securely disposed of in a
  manner that protects against unauthorised access.

Compliance with PDPA 2012:

• At OrcaNation we will comply with all requirements of the Personal Data
  Protection Act (PDPA) and any other relevant data protection laws in Singapore
  and in other jurisdictions in which we operate including European GDPR.
• At OrcaNation we commit to train employees concerning data protection
  practices and procedures to ensure compliance with the PDPA and other related
  jurisdictional laws.
